Should businesses have to supply female uniforms to male employees who identify as female? That’s the question under consideration in a lawsuit against a small, family-owned funeral service in Detroit, Michigan. The Equal Employment Opportunity Commission is interpreting “sex” in Title VII of the US Civil Rights Act of 1964 (a nondiscrimination law) not as biological sex but as gender identity. The EEOC declares that this family-owned business has run afoul of that interpretation for asking a male employee to wear a suit and tie.
